#### After 8 Years, Justice Delivered to Contractual Employee Parin Rawal;

 

New Delhi / Udaipur – In a landmark judgment affirming the rights of contractual employees, the Hon’ble Supreme Court of India has dismissed the appeal filed by the Rajasthan Government and upheld the 2018 verdict passed by the Rajasthan High Court, Jodhpur in favor of Parin Rawal, a contractual MIS Manager working at the Zila Parishad (District Council) in Udaipur.

Background of the Case:

In 2018, Parin Rawal had filed a civil writ petition before the Rajasthan High Court, Jodhpur, demanding equal pay for equal work. He argued that although he was working on the post of MIS Manager, the nature and responsibility of his duties were equivalent to that of a Programmer, yet he was being paid significantly less.

After thorough arguments presented by Advocate Ramesh Prajapat, Hon’ble Justice Arun Bhansali ruled in favor of Parin Rawal and ordered that he be paid salary equal to that of a Programmer, reinforcing the principle of “Equal Pay for Equal Work.”

Government’s Appeal and Subsequent Proceedings:

Unhappy with this verdict, the Rajasthan Government appealed to the division bench of the Rajasthan High Court. However, even there, the government’s plea was dismissed by a bench comprising Hon’ble Chief Justice Indrajit Mahanty and Hon’ble Justice Sandeep Mehta, who upheld the single bench’s order and directed the state government to comply with it.

Despite these rulings, the state government escalated the matter to the Hon’ble Supreme Court in the case titled Rajasthan Government vs. Parin Rawal. The government sought to challenge the Rajasthan High Court’s judgment.

Supreme Court’s Final Judgment:

During the hearings in the Supreme Court, Parin Rawal was represented by Advocate Rahul Trivedi and Advocate Prabodh Kumar, who strongly defended his case. The Hon’ble bench comprising Justice Pamidighantam Sri Narasimha and Justice Jaymalya Bagchi dismissed the government’s appeal and upheld the Rajasthan High Court’s decision, thus granting Parin Rawal long-awaited justice.

Victory for Parin Rawal and Relief for Contractual Workers:

With this ruling, Parin Rawal’s eight-year-long struggle has ended in victory. The decision is not just a personal triumph but sets a significant precedent for thousands of other contractual workers across Rajasthan and beyond. It reinforces the constitutional principle that any worker, regardless of employment status, performing duties equivalent to a regular employee, is entitled to equal pay.

Now, it is the responsibility of the Rajasthan Government to implement the 14.11.2018 order of the High Court and provide salary benefits to Parin Rawal equivalent to those of a Programmer.

The judgment has brought a wave of joy and encouragement among low-paid contractual employees across the state.
